Stablecoins in Ghana: What Evidence Establishes a Provider’s Regulatory Scope?

4 min read

A Ghanaian company should not infer that a service is available to it merely because the provider appears in a virtual-asset announcement. The evidence must connect the proposed activity, contracting entity and applicable operating conditions. That is particularly important for sandbox participants.

Read the status before relying on the brand

Ghana’s SEC identifies the Virtual Asset Service Providers Act, 2025, Act 1154, as the basis for a framework in which it is a co-regulator. Its sandbox provides supervised testing. That pathway does not amount to unrestricted permission for every commercial service.

The corporate question is narrower: does this transaction fall within the permitted activity, client group and limits? A public announcement is a starting document. Contractual terms and confirmation of scope should complete the file.

The Bank of Ghana also describes its Virtual Assets Department as a regulatory and supervisory function working with the SEC and Financial Intelligence Centre. Distinguish service supervision from financial-intelligence matters. The institutional page describes an architecture; it does not establish an individual operator’s licence.

Classify the evidence

Document offered

What it helps establish

What remains unresolved

Legislation or regulatory announcement

Framework and institutional role

Application to the specific service

Sandbox announcement

Identified participation or testing route

Current conditions and operating limits

Sales presentation

Provider’s stated proposition

Contracting identity and substantiated claims

Service agreement

Proposed client responsibilities and rights

Consistency with regulatory scope and exit arrangements

This prevents meaningful regulatory progress from being overstated as a commercial guarantee. It also gives the provider a clear evidence request.

Worked example: custody added to a payment offer

An Accra company considers a USD 25,000 payment. The intermediary supplies evidence of participation in a testing programme, then offers to retain a balance for three months.

Payment execution and extended custody need separate assessment. The company asks whether custody is included in the admitted scope, which entity holds the assets and how the customer recovers them. The file remains unapprovable while these points are unanswered. Calling custody a technical feature does not remove the question.

Identify obligations beyond provider status

An intermediary’s status does not by itself resolve the customer’s foreign-exchange, invoicing, tax or accounting questions. Distinguish domestic payments from payments to non-residents and obtain advice on the proposed route.

Record the verification date, official source and provider response. Allocate each open question to the appropriate owner: local legal review, compliance, banking or treasury. No single response should be presented as authorising the whole transaction chain.

What the public record already establishes

The Bank of Ghana portal identifies Act 1154 as the framework’s legal foundation and describes its Virtual Assets Department. The SEC’s enactment announcement outlines its market-related responsibilities. These official statements establish the announced allocation of roles, without substituting for the full enacted statute.

Coordination is not an additional operating licence

For the hypothetical exchange provider adding custody, the decision is to continue examining the identified exchange service while withholding assets from the new custody service until its scope is evidenced. Sandbox participation does not authorise every service offered by the group.

This analysis assesses public status and scope evidence. A decision on a particular contract still requires legal qualification of the service, its conditions and the rules applicable to the corporate customer.

Turn research into a usable conclusion

BECTRA can organise a short decision file with four possible findings: service within confirmed scope, service outside scope, insufficient evidence or refreshed confirmation required. Each finding should identify its supporting documents and conditions.

The purpose is a decision record management can challenge and revisit. It is not to award a licence on a regulator’s behalf or infer unrestricted permission from a participant list.

What the Act adds to the announcements

The full text of Act 1154 separates registration, licensing and a supervised-person waiver according to activity and applicable conditions (sections 6–14 and 51). Its Schedule distinguishes exchange, custodial wallet services and payment processing. Permission for one does not establish permission for the others.

Section 74 contains a ninety-day transition tied to commencement. Read it with effective implementation measures and individual decisions; this article does not derive a current filing deadline from assent alone. Sandbox activity remains subject to its conditions, including section 9 of the SEC’s 2026 Guidelines.

The complete facsimile reviewed bears Assembly Press publication details and is hosted by a legal publisher, rather than a regulator. BoG/SEC sources corroborate the framework and implementation. The evidence file retains that provenance.
